General Terms and Conditions

  1. In case of accident or theft, you must contact the following telephone numbers within 24 hours after the incident. As well as to report the theft to the LOCAL POLICE, NATIONAL POLICE OR CIVIL GUARD at 112. Also to the contact telephone number of the lessee COMPANY +34871930471 +34 671172069. The Client must present to Ride Over Mallorca sl’s office, within 48 hours after the incident, the friendly report, completed by both parties, and, in case of theft, the complaint and the keys of the vehicle. If the Client has not contracted the PREMIUM coverage and the vehicle does not appear before the end of the contract date, he/she must pay 80% (percentage) of the value of the vehicle at the P.V.P. price.
  2. By signing the present contract, the driver/s acknowledge having read and accepted the conditions detailed in the present contract necessary for the driving of the vehicle.
  3. It undertakes to respect at all times the traffic regulations in force and be responsible for any penalties that may arise from the misuse or breach of the regulations and for the duration of this contract.
  4. The Company is exempt from any liability for damages caused by bad or reckless driving, as well as driving under the influence of alcohol or drugs.
  5. Any damage that may be caused by the LESSEE shall be subject to an expert appraisal and subsequent estimate by the LESSOR. This implies that the deposit/security deposit cannot be returned until the value of the repair is certified with a provisional estimate.
  6. In case of breach of any of the conditions detailed above, RIDE OVER MALLORCA SL may terminate this contract at any time by demanding the return of the vehicle and the holder of this contract undertakes to deliver, as soon as possible, the vehicle to our base.
  7. Authorizes RIDE OVER MALLORCA SL, to use this data for our marketing operations and include them in our database for future communication actions.

ARTICLE 1. SCOPE OF THE CONTRACT

These General Terms and Conditions apply to the vehicle reservation service (hereinafter, the Service) that RIDE OVER MALLORCA SL, with registered office at Calle Espartero 13, 07014, Palma, Balearic Islands, Spain, makes available to the user on its website www.rideovermallorca.es and in the rental contract. The use of the Service by the Customer presupposes, in any case, the adherence and conformity to the General Terms and Conditions of Contract in the version published by www.rideovermallorca.es at the time of access to the Service. Therefore, it is advisable that the Customer reads the General Conditions before using the Service, which will be present at all times in Spanish in the section where the Service is available. As proof of the knowledge and acceptance of the same, the Client will be obliged to sign this sheet attached to the contract of which it forms part if it is in agreement, once the characteristics of its reservation have been selected and the personal data necessary to formalize the same have been provided.

VEHICLE RESERVATION SERVICE

To use the Service, users must follow the instructions required on the website www.rideovermallorca.es or in the Contract provided at the time of delivery of the vehicle.

  1. Selection of booking data (useful information about the driver(s), rates, equipment selected by the Customer, place of delivery and pick-up will be required).
  2. Reading and acceptance of these General Conditions.
  3. It will be sent to the user’s e-mail account with the details of the reservation made, as well as a copy of these General Conditions, always supported by the corresponding reservation confirmation document.
  4. The reservation of vehicles through the website www.rideovermallorca.es is completely free of charge.
  5. The credit card number requested for the purpose of reservation or payment of the vehicle rental. We accept international Visa and Mastercard or cards issued by Spanish banks.
  6. Payment by credit card will only be made through the page designated by our entity, and the deposit will not be charged until the moment of delivery of the vehicle.
  7. Payment by credit card must be made by the driver(s). Otherwise, the cardholder must be at the place of delivery of the vehicle.
  8. Prices: rental or sale prices are shown on our website www.rideonmallorca.es, including 21% VAT.
  9. By signing, the Client authorizes our COMPANY to store the Client’s debit/credit card information in its database and use it to collect all damages that may be caused by the Client to the rented vehicle or to the COMPANY itself.

ARTICLE 2. PICK-UP AND RETURN OF THE MOTORCYCLE

If for reasons beyond our COMPANY’s control, the Client does not pick up the motorcycle at the time stipulated in the reservation or contract, we will not extend the contract nor will we pay for the hours or days not used.

The vehicle will be delivered at the time requested by the Customer in the online reservation form on the website www.rideonmallorca.es. In the event that the contracting party wishes to pick up before the requested time, he/she must pay the corresponding amount.

The return time previously requested by the Contracting Party must be respected WITHOUT EXCEPTIONS. In the event of not returning the motorcycle at the agreed time, the Customer has 30 minutes of courtesy, after this time the Customer will be charged an extra day, plus an additional penalty for damages caused to the COMPANY as it is not legal to circulate with an expired rental contract. The contract shall only be terminated when the HIRER presents himself/herself at the store where the vehicle is to be returned, with the vehicle and its keys, helmets, padlock and documentation.

In case of home delivery or return, the COMPANY warns that due to traffic difficulties it may sometimes arrive earlier or later than the agreed time. The COMPANY will keep the Customer informed at all times of the status of its delivery.

The HIRER accepts that he/she has received the vehicle in good working order, including the two tires and accessories (keys, helmets and padlock) and the vehicle’s documentation. It must be returned in the same conditions.

ARTICLE 3. DISCLAIMER OF LIABILITY.

  1. RIDE OVER MALLORCA S.L. is not responsible for any damages that may arise from, but not limited to:
    • Delays or blockages in the Internet network caused by deficiencies or overloads, as well as any other electronic system.
    • The impossibility to provide the Service or allow access for any reason.
    • Of any escape from its control that prevents the reservation from becoming effective. Anomalous operation is understood to mean the incorrect issuance of reservations or errors of any kind.
  2. In the event that the user wishes to submit a complaint to RIDE OVER MALLORCA SL, you may send a letter to the address C/Espartero 13, 07014, Palma, Baleares, Spain.

ARTICLE 4. APPLICABLE LAW AND JURISDICTION

These General Conditions shall be governed by Spanish Law, which shall be applicable in all matters not provided for in these General Conditions regarding interpretation, validity and execution. The parties expressly submit to the courts and tribunals of the place of performance of the obligation to settle any dispute that may arise in the interpretation and/or execution of these General Conditions of Contract.

ARTICLE 5. GENERAL RENTAL CONDITIONS

RIDE OVER MALLORCA SL (referred to as “RENTER”) rents to the person/s identified in the contract as driver/s and/or payer/s (referred to as “RENTER”) the vehicle referred to in the contract, in accordance with the clauses and conditions contained herein, in the annexes hereto, and in relation to the General Tariff in force (a copy of which is available to the HIRER at the rental station and attached to the contract) and to the price agreed upon in the rental contract, according to the selected tariff.

ARTICLE 6. RENTAL REQUIREMENTS (PERSONAL REQUIREMENTS OF DRIVER(S))

  1. For all cylinder capacities it will be essential to have Motorcycle Riding Experience (MINIMUM ONE YEAR). If the worker sees that the Client does not know how to drive the motorcycle, the vehicle will NOT be delivered and the online payment will not be refunded.
    • Motorcycles up to 50cc:
      • AM license or B license with one year of seniority, both in force.
      • For non-EU citizens International Driver’s License
      • Over 21 years of age.
    • Motorcycles up to 125cc:
      • B license more than 3 years old, with A1 license or higher.
      • For non-EU citizens International Driver’s License.
      • Over 21 years of age.
    • Motorcycles up to 200cc, 300cc and 350cc:
      • A2 license.
      • For non-EU citizens International Driver’s License
      • Over 21 years of age)
    • Motorcycles up to 700CC:
      • Carnet A.
      • For non-EU citizens International Driver’s License
      • Older than 25 years old.
  2. Photos, photocopies or reports and/or any other document other than the original ID card will not be accepted.
  3. In case the Client does not meet the above mentioned conditions, the vehicle will NOT be delivered and the amount paid will NOT be refunded.

ARTICLE 7. FINANCIAL REQUIREMENTS

Motorcycles

  • Peugeot Tweet 49cc/125cc, Piaggio Liberty 49cc/125cc, Silence S02 125cc have a security deposit of 300
  • Peugeot Django 125cc, Peugeot Citystar 200cc, Yamaha Tricity 125cc, Kymco Superdink 125cc have a deposit of 400 euros.
  • Peugeot Satelis 300cc has a deposit of 300€.
  • Vespa Primavera 125cc have a deposit of 400€.
  • Piaggio Beverly 350cc have a deposit of 400€, Honda Transalp 650/700 cc have a deposit of 800€, which must be paid in advance by the HIRER. Under no circumstances can the deposit be used to extend the rental period. The payment of this amount must be made by credit card or in cash. Said amount does not cover the total amount of the alleged damages, assuming that the damages to the vehicle exceed the amount of the deposit, they shall be paid by the Client. When the HIRER returns the vehicle together with the keys and the COMPANY terminates the contract, the deposit will be returned. In the event that this has been paid by credit card and the rental period is longer than 28 days, the cost of the transfer for its return shall be borne by the Client.

ARTICLE 8. SPECIFIC GUARANTEES

  1. In the event that the vehicle suffers a breakdown, not an accident, RIDE OVER MALLORCA SL will replace the vehicle as soon as possible and within the established opening hours. If it is not possible to replace the vehicle, the amount corresponding to the days not used at the selected rate will be refunded.
  2. The LESSEE expressly acknowledges and accepts the foregoing and waives any and all claims for indemnification if any.
  3. The DRIVER/RENTER is responsible for the vehicle and any damage caused during the rental unless the RENTAL COMPANY obtains acceptance of full or partial responsibility from a third party. This liability may be partially waived by the payment, per day, of a pre-determined amount. In any case, it should be noted for those RENTERS who have taken this type of guarantee, that there is a non-waivable amount that will be applied in the event of damage to or loss of the vehicle.
  4. In case of an accident, the vehicle will not be replaced, the contract will be terminated and no money will be refunded for the remaining days of the rental.

ARTICLE 9. FUEL

  1. Fuel is not included in any of the rates. RIDE OVER MALLORCA SL will deliver the motorcycle to the driver with a full tank of fuel. The Customer must return the motorcycle with a full tank of fuel. In case of lack of gasoline, you will be charged for the refueling service for time and displacement that must be made by the COMPANY in order to complete the tank. “No exceptions” the following rates:
    • 49CC, 125CC MOTORCYCLES (TWEET/LIBERTY/VESPA MODEL) 20€.
    • MOTORCYCLES, 200CC, 300CC, 400CC and 700CC 30
  2. All our motorcycles use 95 unleaded gasoline. If there is any error in the refueling and as a consequence the motorcycle suffers any damage, the repair will be paid in full by the Client.

ARTICLE 10. MAINTENANCE

  1. The HIRER may not repair the vehicle without prior written authorization from RIDE OVER MALLORCA SL.
  2. Vehicle maintenance and lubrication are included in our rates. Road expenses, subject to the approval of the rental office, will be reimbursed at the end of the rental period upon presentation of the original receipt of payment. (Punctures and/or tire changes resulting from misuse of the vehicle are not included). “No exceptions”
  3. Mechanical wear and tear due to normal use of the vehicle is assumed by the LESSEE.
  4. In case of damage to the vehicle, as well as to its accessories and complements and/or theft thereof, the corresponding charge shall be made to the HIRER for the following concepts and amounts: – Plastics: knocks, scratches. – Glass/mirrors: scratches, cracks, losses, theft. – Lights: broken housings. – Tires: punctures. – Upholstery, dashboard. Accessories: loss, theft. Subject to expertise by the COMPANY RIDE OVER MALLORCA S.L. – In case of loss of keys, the HIRER shall pay for them. The cost of the motorcycle key will depend on the model of the rented motorcycle. The cost of the padlock key is €25, trunk key is €10 and the travel for the delivery of keys or motorcycle locksmith is €80 minimum. – In case of loss of the padlock, you must pay for it. The cost is 25 € and the displacement for delivery of keys or open the motorcycle is 80 € minimum. The corresponding Value Added Tax or tax in lieu thereof shall be added to all the amounts stated above.

ARTICLE 11. VEHICLE COVERAGES

BASIC COVERAGE: Compulsory Civil Liability Insurance, included in the rental rate, which covers damages to third parties, with no excess. The Client accepts full responsibility for any damage caused to the vehicle during the rental, whether partial or total destruction and/or theft or loss of the vehicle. The basic coverage DOES NOT COVER: Personal damages, roadside assistance, medical assistance, damage and/or theft of the vehicle, loss, theft and/or breakage of: keys, accessories and/or personal belongings. If the Client has not contracted the PREMIUM or PREMIUM K&G coverage and the vehicle does not appear before the end of the contract date, he/she must pay 100% (percentage) of the vehicle’s P.V.P. price. IN NO CASE DOES THE BASIC COVERAGE COVER MEDICAL ASSISTANCE FOR PERSONAL DAMAGES, CALL 112!!!!

PREMIUM COVERAGE (ALL RISKS): The PREMIUM coverage (All Risks) covers damage to third parties, damage to the vehicle, as well as total or partial destruction, loss and/or theft with an excess for Peugeot Tweet 49cc/125cc, Piaggio Liberty 49cc/125cc of 500€, for Vespa Primavera 125cc, Peugeot Django 125cc, Yamaha Tricity 125cc, Kymco Superdink 125cc, Silence S02 125cc, Peugeot Satelis 300cc of 800 euros, for Piaggio Beverly 350cc, Honda Transalp 700cc of 1,500 euros. The PREMIUM (All Risks) coverage does not cover: loss and/or breakage of keys, drum breakage except if the problem is caused by a defect in the motorcycle, punctures or salvage as a consequence thereof, roadside assistance due to lack of gasoline or loss and/or breakage of: keys, helmets, padlock. Under no circumstances is the breakage of the motorcycle’s underbody due to misuse of the motorcycle, such as: rims, under engine, motorcycle underbody, etc., covered. In the event of an accident, the motorcycle will be picked up at the Client’s expense and the vehicle will not be replaced. In the event of using fuel that does not correspond to that used on the motorcycle, the repair shall be at the expense of the Renter, loss and/or breakage of accessories and personal belongings. Accidents caused by the effects of alcohol and/or drugs will not be covered. Only one accident per contract will be covered. UNDER NO CIRCUMSTANCES DOES THE RIDER (ALL RISKS) COVERAGE COVER MEDICAL ASSISTANCE FOR PERSONAL INJURY, CALL 112!!!!

PREMIUM K&G (PREMIUM ALL RISK) COVERAGE: Covers all types of accident caused by accident, with a reduction of excess for Peugeot Tweet 49cc/125cc, Piaggio Liberty 49cc/125cc of 0€, for Yamaha Tricity 125cc, Kymco Superdink 125cc, Silence 125cc, Peugeot 200cc of 400€, for, Piaggio Beverly 350cc of 800€, for Honda Transalp of 1000€. Coverage will be for damage to third parties, tire punctures (in any case the breakage of the tire), key breakage (only covers a breakage, never in any case the loss or forgetfulness of these as for example under the saddle), in case of accident covers the collection of the motorcycle within a radius of 15km from where the store is located Ride Over Mallorca sl), partial or total destruction of the vehicle, breakage of vehicle accessories such as helmets, trunk and padlock. (In case of breakage of accessories such as helmet, padlock or keys, only the first breakage would be covered, never the second breakage, and the Customer would have to pay for it). Under no circumstances are broken undercarriages due to misuse of the motorcycle such as, for example: rims, under engine, motorcycle undercarriages. Accidents caused by the effects of alcohol and/or drugs will not be covered. In the event of an accident, the coverage will only cover one accident per contract without replacement of the vehicle. In the event of using fuel that does not correspond to the fuel used on the motorcycle, the repair shall be at the expense of the Contracting Party. IN NO CASE DOES THE PREMIUM K&G COVERAGE (ALL RISKS PREMIUM) COVER MEDICAL ASSISTANCE FOR PERSONAL INJURIES, CALL 112!!!!

  1. Inexperts may only contract Basic Coverage, being exempted PREMIUM Coverage, PREMIUM K&G Coverage (All Risks Premium).
  2. In the event that the Client must pay the total amount of the vehicle due to theft and the COMPANY recovers the vehicle in the future, it will proceed to assess the damage done and return to the Client the proportional part charged for the theft.
  3. The Client accepts that he/she has been duly warned that neither the insurance company, nor the extra coverage, nor RIDE OVER MALLORCA SL have medical assistance of any kind, whether in hospitals, clinics and/or any other type of public or private establishment, neither for the Policy Holder, nor for the passenger in case there is one. Neither shall they be covered for sick leave of any kind, as a consequence of falls, accidents, etc., whether due to the fault of the driver assigned in the contract or due to the fault of a third party or fortuitous causes. RIDE OVER MALLORCA SL will in no case provide the Client with the details of the insurance company.

ARTICLE 12. ROADSIDE ASSISTANCE

The roadside assistance service is included in the price if the damage is specific to the motorcycle and the pick-up is within 15km of the store. In case the distance is greater RIDE OVER MALLORCA SL will provide the Customer with the telephone number of the towing service to be hired, being this charge your responsibility.

ARTICLE 13. VEHICLE USE

  1. The HIRER undertakes to use and drive the vehicle in accordance with the basic rules of driving, circulation and in accordance with the specifications of use of the type of vehicle, information provided by RIDE OVER MALLORCA SL. with the Safe Driving Tips printed on the back of the rental contract.
  2. The HIRER is strictly forbidden to leave the territory OF THE ISLAND OF MALLORCA with the motorcycle rented from RIDE OVER MALLORCA SL.
  3. The HIRER is forbidden to circulate outside the urban area of PALMA DE MALLORCA with the 49cc motorcycles, as well as it is forbidden to circulate on highways and/or freeways. For the rest of the cylinder capacity, 125cc, 200cc, 300cc, 350cc, 400cc and 700cc it is forbidden to leave MALLORCA unless authorized in writing by RIDE OVER MALLORCA SL.
  4. The HIRER is not authorized by RIDE OVER MALLORCA SL to carry passengers. In the event that the Policy Holder carries a passenger, he/she shall do so at his/her own risk.
  5. The HIRER undertakes not to use the vehicle and/or not to allow it to be used in the following cases: Driving the vehicle on unauthorized roads or whose condition may pose a risk of damage to the vehicle or accessory (GPS, helmets, carrying case or any object provided by RIDE OVER MALLORCA SL), pushing or towing any vehicle or any other object, rolling or not; participating in competitions, official or not; performing endurance tests of materials, accessories or products for automobiles (unless expressly authorized in writing by the HIRER); driving under the influence of alcohol, narcotics or any other type of narcotic substances; transporting flammable and/or dangerous goods, toxic, noxious and/or radioactive products or products that violate the legal provisions in force, as well as transporting goods in weight, quantity and/or volume exceeding that authorized in the vehicle’s Road Permit and/or Technical Inspection Card; transporting passengers in excess of the number authorized and indicated in the vehicle’s Road Permit and/or Technical Inspection Card.
  6. Only the person or persons identified and accepted by the LESSOR in the rental agreement are authorized to drive the vehicle, provided that they are over 21 years of age and hold a valid driver’s license for at least three years. Only the following will be considered as valid driving licenses in Spain: -Those issued in accordance with Spanish legislation in force; -Those issued by the member states of the European Union in accordance with Community regulations; -Those issued by other countries or of an international nature which were recognized as valid for the purpose of allowing driving in Spain. Notwithstanding the foregoing, the validity of such permits shall be conditional upon them being in force and the holder being of the age required under Spanish regulations to obtain the equivalent Spanish permit. The LESSOR reserves the express right to refuse the rental of the vehicle in the event that the person indicated by the LESSEE to drive the vehicle does not duly prove to be the holder of a valid driving license in force at the time of delivery of the vehicle to the LESSEE in accordance with the provisions of the contract.
  7. The HIRER undertakes to keep the vehicle locked and in a safe place, as well as properly parked when not in use and not to keep the vehicle’s documents inside the vehicle in order to avoid greater evils in case of theft.
  8. The LESSEE is prohibited from assigning, renting, mortgaging, pledging, selling or in any way giving as security: the vehicle, the rental agreement, keys, documentation, equipment, tools and/or accessories of the vehicle and/or any part or piece thereof; or dealing with the foregoing in such a way as to cause prejudice to the LESSOR. Also, it is forbidden to vary any technical feature of the vehicle or make any modification of its exterior and/or interior appearance (unless authorized in writing by RIDE OVER MALLORCA SL).
  9. When any of the lights on the instrument panel that detect an anomaly in the operation of the vehicle illuminate or when external signs indicating a breakdown or malfunction of the vehicle are perceived, the HIRER must stop the vehicle as soon as possible and contact the LESSOR or the Roadside Assistance Company arranged by the LESSEE, and only the latter. Charges will only be accepted on behalf of the Assistance Company in cases of urgency and when expressly authorized by the LANDLORD.
  10. It is not permitted to transport the vehicle on board any type of boat, truck or means of transport (unless expressly authorized in writing by the LESSOR).
  11. The vehicle may not be used inside port, airport, aerodrome and/or similar areas not accessible to public traffic, unless expressly authorized in writing by the LESSOR. In the event that the LANDLORD grants his consent to the LESSEE pursuant to the foregoing, the LANDLORD shall inform the LESSEE of the conditions of third party liability insurance coverage that may be applicable in such event, which shall vary depending on the circumstances. Failure to comply with this clause shall be the sole responsibility of the LESSEE.
  12. Any prejudice of any kind that the LESSOR may suffer as a result of non-compliance with the conditions set forth in this article and/or for use other than that agreed upon by the LESSEE, authorizes the LESSOR to remove the vehicle from the LESSEE and to invoice and collect from the LESSEE the amounts resulting in accordance with the provisions of article 10.4 of these General Terms and Conditions.
  13. No refund is possible if the vehicle is returned before the expiration date of the contract.
  14. In the event of a fine, the Client shall be responsible and shall pay the fine as soon as possible. Also, you must pay RIDE OVER MALLORCA SL the sum of 45 € for Administrative Management. In the event that the Client’s vehicle is removed, the charge for collecting the vehicle from the municipal depot will be a minimum of 250€.

ARTICLE 14. EXTENSION AND CANCELLATION OF THE CONTRACT

  1. In the event that the Client wishes to extend the contract, he/she must notify RIDE OVER MALLORCA SL. Such extension shall be subject to the availability of vehicles and disposition of the COMPANY, upon payment and renewal of the contract. For such extension and/or renewal, you must visit one of our offices. Extensions and/or renewals are not made by any means other than in person at our office.
  2. In the event that the Client wishes to cancel the reservation, he/she must notify RIDE OVER MALLORCA SL. If the cancellation is made 48 hours in advance, the money previously paid by the Client will be refunded. The credit will be made directly to your credit card. RIDE OVER MALLORCA SL will not be responsible for any bank fees that may exist in the process. In the event that the cancellation is made with less than the indicated time of anticipation, the money paid will not be refunded.
